Terms and Conditions

Article 1 – Definitions

In these Terms and Conditions, the following definitions apply:

Cooling-off period: the period within which the consumer can exercise their right of withdrawal.
Consumer: the natural person not acting in the course of a business or profession who enters into a distance contract with the entrepreneur.
Day: calendar day.
Continuous transaction: a distance contract relating to a series of products and/or services where delivery and/or purchase obligations are spread over time.
Durable data carrier: any means that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction.
Right of withdrawal: the possibility for the consumer to withdraw from the distance contract within the cooling-off period.
Entrepreneur: the natural or legal person offering products and/or services to consumers at a distance.
Distance contract: a contract concluded within an organised system for distance selling without the simultaneous physical presence of the consumer and entrepreneur.
Means of distance communication: any means that can be used to conclude a contract without the consumer and entrepreneur being in the same place at the same time.
Terms and Conditions: these Terms and Conditions of the entrepreneur.

Article 3 – Applicability

These Terms and Conditions apply to every offer made by the entrepreneur and to every distance contract and order between entrepreneur and consumer.

Before the distance contract is concluded, these Terms and Conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated where the Terms and Conditions can be inspected and that they will be sent free of charge upon request.

If the contract is concluded electronically, the Terms and Conditions may be made available in such a way that the consumer can easily store them on a durable data carrier.

If additional product or service conditions apply, the consumer may always rely on the most favourable provision in case of conflict.


Article 4 – The Offer

The offer is non-binding. The entrepreneur may change or adjust the offer.

The offer contains a complete and accurate description of the products and/or services offered.

Obvious mistakes or errors in the offer do not bind the entrepreneur.

All images and specifications are indicative and cannot be a reason for compensation or cancellation.

Prices exclude import duties and VAT where applicable. These costs may be charged by customs or courier services.


Article 5 – The Agreement

The agreement is concluded when the consumer accepts the offer and meets the conditions set.

The entrepreneur confirms receipt of the order electronically.

The entrepreneur may refuse an order if there are justified reasons (such as payment risk).


Article 6 – Right of Withdrawal

Consumers have the right to withdraw from the purchase within 30 days after receiving the product without giving any reason.

During this period, the consumer must handle the product carefully and only unpack it as necessary to assess it.

If the consumer uses the right of withdrawal, the product must be returned in original condition and packaging where reasonably possible.


Article 7 – Costs in case of withdrawal

Return costs are borne by the consumer.

Refunds will be processed within 14 days after receipt of the returned product or proof of return.


Article 8 – Exclusion of the right of withdrawal

The right of withdrawal may be excluded for:

  • personalised or custom-made products
  • hygiene products with broken seals
  • products that cannot be returned due to their nature
  • perishable goods
  • sealed audio/video/software products once unsealed

Article 9 – Pricing

Prices will not be increased during the validity period of the offer, except for VAT changes.

Prices are subject to obvious errors.


Article 10 – Conformity and Warranty

Products must meet the agreement, specifications, and reasonable expectations.

Warranty does not affect statutory rights.


Article 11 – Delivery

Delivery will take place within 30 days unless otherwise agreed.

Risk transfers upon delivery to the consumer.


Article 12 – Complaints

Complaints must be submitted within 7 days.

Responses will be provided within 14 days.


Article 13 – Governing Law

Dutch law applies to all agreements.
